Binary Options Regulation, A New Sheriff In Town.
Binary options regulation is a hot issue today for traders and brokers alike. The wild west atmosphere of the online digital binary options industry is starting to calm down and now there is a new sheriff in town. Regulation first started with the CFTC in the U. S. and was later followed by regulatory action by CySEC in the EU and the FSA in Japan. Now, the South American nation of Uruguay has stepped onto the scene as well. Brokers, regulators and government officials have come together under Law 15921 to provide a safe environment for both traders and brokers alike. The law is broad and intended for the set-up of Free Trade Zones in order to stimulate international trade, trade that includes financial and other trading services.
Uruguay Free Trade Zones.
The Uruguay Free Trade Zones were set up in the late 80’s after the passing of Law 15921. The senate and House of Representatives of the Oriental Republic of Uruguay, a meeting of the general assembly, passed the legislation as a “matter of national interest”, as the statute itself states. The zones are intended for the promotion and development of Uruguay businesses in order to make them more attractive and competitive on the world market. The zones are also used to attract foreign investment in Uruguay business. Within the law there are a few areas of particular interest to binary traders and the industry at large. For one, Article 2 defines how the zones are to be used. Trading of financial and material goods are one use, also included are “all types of services not restricted by national law” and “other activities that may prove beneficial to the economy”.
Article 5 is where is it really starts to get interesting in the perspective of regulation. It’s one thing to set up a place where a broker can open shop, it’s another to provide an actual framework of regulation and oversight. The Uruguay Free Trade Zones are regulated by the Ministry of Finance through the Free Trade Zone Bureau, an agency set up to operate the zones, approve applications and enforce sanctions. The bureau is assisted by an advisory committee consisting of five people both elected and appointed. The job of the bureau and the advisory committee is to ensure that zones and businesses within them are operated in the best interests of Uruguay.
In article 10 the application process is laid out. All private businesses must prove through an application process that their business is feasible. They must also show that it is a benefit to the economy as well as in the best interests of Uruguay. Those not complying with the application process or with regulations following approval are subject to fines up to 12.5 million Uruguayan Pesos, a hefty sum in any currency. Further on in the legislation, Article 16, contract specifications are laid out in such a manner that all contracts between users of the FTZ are void unless approved by the FTZ Bureau.

Japan Prepares to Regulate Binary Options.

Japanese regulators have revealed that they would soon officially legalize and regulate binary options in the country. While this definitely might sound exciting to some traders, overall it might turn out to be a negative event due to the strange nature of the proposed regulations.
Earlier in 2013 Japanese lawmakers explained that sometimes during the year they would officially legalize and regulate binary options. This is because they have realized that binary option trading is a mainstream accepted practice in the country.
In order to achieve this, earlier the year lawmakers have created a commission that received the task of devising a set of regulations that would have to be adopted during this year in order to regulate and legalize binary options.
When the commission in question was formed, the Financial Futures Association of Japan (FFAJ) also released a report that contained a set of guidelines that the commission in question would have to follow when devising the country’s binary options laws.

– Binary options contracts can only be sold if they have expiration times above 2 hours.
This measure was implemented in order to prevent traders from falling victims to binary options brokers that offer contracts with short expiration times. This is because contracts with short expiration times are widely regarded as being based on gambling rather than trading.
However, these contracts are at the same time also extremely popular in the ranks of traders. Experts believe that if such contracts would be outlawed then a very significant number of traders would prefer to continue to trade at binary options brokers that operate outside of the law.
This is because brokers operating from offshore jurisdictions would continue to be able to offer any kind of contracts that they want. This way, brokers that are licensed in the country would be disadvantaged compared to illegal brokers.
– Brokers will have to point out that if traders lose, all their investments will be lost too.
– Show traders their profit and loss ratio.
– Implement a questionnaire that traders will have to fill in after registering. Based on the number of correct answers, brokers will have to establish maximum deposit limits on trader accounts.
– Implement a common strike price on all contacts offered.
– Payout rates should not be modified while a trade is ongoing.
– Trading should not be unexpectedly suspended by brokers.
Experts believe that brokers are actually respecting most of these guidelines at this very moment. However, the first requirement can cause some serious complications due to the fact that it would encourage traders to continue to trade at brokers operating from offshore jurisdictions.
If that would be the case, then the Japanese binary options regulatory process will turn out to be a failure. If brokers would still prefer registering at offshore and unlicensed brokers then the laws japan would adopt would not serve traders interests.
However, as it’s the case in other domains as well regulators most of the time have no clear idea about market realities and customer demand. For this reason, regulators are often driven towards implementing laws and regulations that are completely detached from reality.
Japan is at this moment one of the largest binary options trading markets on the planet. It would be very sad for the market as a whole if Japan would implement weird laws and regulations that would basically deadlock the entire online trading industry of the country.
The same basically happened in the United States as well where regulators implement such strict laws that at this moment only one company was capable of paying the exorbitantly high licensing fees.
